Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MonkMode web application ("Service") operated by MonkMode AI Pty Ltd ("Company", "we", "us", "our"), an Australian company. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.

1. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2. The Service

MonkMode provides an AI-powered appearance analysis service. You upload a selfie photograph, and our system analyzes visible facial and hair features to generate personalized grooming, hairstyle, skincare, and style recommendations. The Service is provided for informational and entertainment purposes only.

The Service is not a medical, dermatological, or professional grooming service. Recommendations generated by MonkMode are algorithmic suggestions based on general appearance principles and should not be treated as professional advice. We make no guarantee that following any recommendation will produce any particular result.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Upload images of other people without their explicit consent
• Upload images of minors
• Attempt to reverse-engineer, scrape, or extract data from the Service
• Use the Service to harass, defame, or harm any person
• Circumvent any technical measures we use to restrict access
• Use automated tools (bots, scrapers) to access the Service
• Upload any image that is obscene, illegal, or violates any third party's rights

Violation of these rules may result in immediate account termination without refund.

5. Intellectual Property

All content, design, code, trademarks, and materials on the Service are owned by or licensed to MonkMode AI Pty Ltd and are protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

You retain ownership of any selfie images you upload. By uploading an image, you grant us a limited, temporary licence to process that image solely for the purpose of generating your analysis. This licence terminates when the analysis is complete and the image is discarded.

6. Subscriptions and Payments

MonkMode offers paid subscription plans ("Pro") processed through Stripe, Inc. By subscribing, you agree to Stripe's Terms of Service. All prices are displayed in USD unless otherwise stated.

Weekly subscriptions begin after a 3-day free trial and auto-renew weekly until cancelled. Annual subscriptions are billed annually and auto-renew unless cancelled at least 24 hours before the renewal date. Lifetime access is a one-time payment with no recurring charges.

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time except where required by Australian Consumer Law.

We offer a 7-day money-back guarantee on all paid plans. If you are not satisfied, contact us within 7 days of your first payment for a full refund.

7. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited. Where the Australian Consumer Law applies, our liability is limited, at our option, to re-supplying the service or refunding the price paid.

8. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without any warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any particular result will be achieved from following our recommendations. Appearance analysis is inherently subjective and our AI system may produce inaccurate or inapplicable results.

9. Limitation of Liability

To the maximum extent permitted by law, MonkMode AI Pty Ltd and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, goodwill, or other intangible losses. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by email or by posting a notice on the Service. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
